Terms and Conditions of Rental - Agreement - The Willows Lakehouse
Welcome to The Willows Lakehouse, the best-kept getaway secret in the Midwest. In order to ensure continued enjoyment for your next visit and other guests, please read carefully before you submit your reservations form. By submitting your reservations form you are agreeing with our terms and conditions of use. If you make your Willows reservation via telephone or email you will receive a copy of the Terms & Conditions in the mail, which you will need to sign and return prior to your visit. Please check the website immediately before your stay for any changes or notices. The Willows reserves the right to change terms and rates effective immediately.
This agreement serves as the rental contract between you (“Responsible Party”) and Willows Lakehouse, LLC (“The Willows”).
Check-In is 3pm and Check-Out is 11am for Lakehouse overnight guests. For day-only events, arrangements for access the evening before are individualized.
In case of fire on the grounds, cabin, or boat dock, call 911 immediately. Fire extinguishers are located under the kitchen sink, in the Bar-B-Q cart, and on the boat dock for small situations.
Willows Lake
The lake is fed by natural watershed and the grounds are maintained to assure health of the grasslands and wildlife that depend on them. The water is not potable and drinking of it, as with any natural reservoir, should be avoided. The Willows is not responsible for ANY disease, infection, injury or other illness to guest or their party deriving from swimming in or exposure to the lake.
No lifeguard is provided and swimming is intended only for the area specifically marked with rope and buoys. SWIM AT YOUR OWN RISK. Bring flotation devices for your own use. DO NOT LEAVE CHILDREN UNATTENDED OUTDOORS FOR ANY LENGTH OF TIME.
Willows Lake is stocked with catfish, bluegill, crappie and largemouth bass. We manage carefully to maintain an ecological balance that will provide a rewarding experience for all fishermen! For 2010, Bass are catch and release except for a 10-12” slot, with a limit of 5.Catfish are limited at 3. Please throw back the large fish of all species so other anglers, especially the youngsters who get the biggest thrill, can duplicate your exhilaration. For panfish, please keep as many of the hand -sized or smaller bluegill, sunfish and crappie you can eat while at the Willows. . We all want every angler to have success every time!
Again this year we are continuing our population survey. You can help us maintain a great fishery by providing some information, and earn a chance for special gifts. Adult guests who complete a fishing survey for each outing will be entered for a monthly drawing, which will award Willows Wear apparel to the lucky winner! Simply complete the provided “Catchy Info” cards found in the boxes at the dock or cabin and leave them there. We will contact the winners of the drawing each month. If you complete a card for each day, that means 2 cards and double the chances of winning!
The Lakehouse
Smoking is expressly prohibited in the cabin, on the wooden deck, gazebo or boat dock; we expect outdoor smoking will be curtailed in the event of dry weather fire hazard and in respect to others’ sensitivities.
Pets are not allowed in the cabin. Ask about an available medium sized travel cage to house your dog outside. Then, Fido can romp along as you roam the 160 acres of rolling upland landscape. The Willows is not responsible for ANY injury, illness, runaway or other untoward event affecting your pet during your stay. You are responsible for damage to the lakehouse and its contents by your pet(s) or those of you invited guests.
Kitchen, cook and dining ware, linens and towels are provided for all guests. Daily maid service is available at additional charge; specific additional options available on request. Help yourself to the continental breakfast provided for your first morning. Bacon and eggs are supplied in addition for you to prepare! No ‘carry out’, please.
Rates apply to use of the lakehouse, lake, grounds and gazebo.
Additional fees apply for the following amenities:
Large party tent 30’ X 60’$500 first day, additional consecutive days reduced
Room size 10’ X 12’outdoor dining / netted sun shelter: $30/day
Volleyball/Badminton net and ground marking: $50/day
Porta-potties are required for parties over 40; discount rental available.
Payment Provisions
Upon payment of your non-refundable reservation deposit/cancellation fee of $100, you will receive a confirmation invoice and copy of this agreement. By submitting your reservations form through our website you are agreeing with our terms and conditions of use. In addition, you will receive two copies of the Terms & Conditions in the mail; please sign and return one copy, retaining one for your records.
Full payment is due 30 days in advance by check, cash, VISA or MasterCard.
Cancellations or date changes made more than 30 days in advance forfeit the reservation deposit.
Cancellations or reduced stays made less than 30 days in advance forfeit the first day’s rent; if we can fill 1/2 or more of the booked stay, your rent (less $100 reservation deposit) will be refunded.
A separate check for security deposit of $200, due 30 days in advance, will be retained until after departure and only cashed to cover the costs of damage, replacement of missing items (inventory routinely taken before and after each guest stay), or extraordinary cleanup and/or repairs resulting from you or your party’s action. Otherwise, it will be returned promptly with a ‘thank you’ bonus for your stewardship of the property
Loss and Damage
The Willows is not responsible for loss, damage to or theft of your property or the property of your guests. By accepting these terms, you agree to hold harmless The Willows for and from any claims for injuries or injury or damages to you, your family, or guests. If any of the facilities are used by minors under the age of 18, you agree to reimburse and hold harmless The Willows for and from any claims for injuries or damages to the minors which are not covered by liability insurance. You, as Responsible Party, assume sole liability for injury or loss occurring to your party (family, friends, and invited guests) during their use of the facilities during your stay. You will also be responsible for damages beyond normal wear and tear or natural calamity (for example rainstorm, lightning, flooding, tornado, and earthquake), missing items or other negligent or avoidable damage to the lakehouse or grounds occurring during your stay, whether inflicted by you or your invited guests.
Dispute Resolution
Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled either in small claims court per the laws of the state of Missouri or by arbitration, the method to be chosen by the plaintiff. Arbitration will be administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
